In April 2016, [K.P. Yohannan's - right] Gospel for Asia’s celebrity attorneysasked the Western Arkansas District Court to either dismiss the RICO suit against them or to require plaintiffs Matthew and Jennifer Dickson to submit to binding arbitration. Today, the court declined to dismiss the case. Furthermore, they declined to require the Dicksons to enter arbitration, ruling that their employment contract did not envision a case such as this.
In short, the RICO suit against Gospel for Asia will go forward.
Plaintiffs’ complaint is sufficiently pled to overcome the hurdles posed by Defendants’ motions to dismiss, and this case must proceed to discovery.
III. Conclusion
IT IS THEREFORE ORDERED that Defendants’ motion to compel arbitration (Doc. 23) is DENIED.
IT IS FURTHER ORDERED that Defendants’ motions to dismiss (Docs. 25 and 27) are DENIED.
IT IS SO ORDERED this 18th day of January, 2017.

Isn't the whole complaint that GFA elevates form over substance and in the process swindles people?

Looks like the judge basically sided with the plaintiffs on all points on the question of whether it should proceed.

Real discovery simply will not happen. I have said that before. Enough has already been discovered to show that GFA is a pure and total fraud. KP cannot allow discovery to proceed so it simply will not. Instead expect more delaying motions. I still think this is bound to end up in a summary judgment, probably after years of more rangling. https://en.wikipedia.org/wiki/... This will only happen once the judge loses all patience with GFA's lawyers. It has already been almost a full year since the lawsuit was first filed.

You're probably right about the legal games GFA lawyers will attempt to pull off. This is also just one part of the worldwide GFA soap opera/money laundering scheme.
I wonder if specific defendants will have to testify, like some of the higher-ups? If so, getting the appropriate defendants in a courtroom could be challenging for GFA and something their attorneys would want to avoid. Surely there's some legal reason KP doesn't come back to the US - is it to avoid receiving subpoenas? That could give their lawyers another reason to postpone frequently, perform other legal maneuvers, and maybe even try to arrange a lowball settlement in exchange for not pleading guilty.
Where are the government cases vs GFA & Co, anyway? I honestly expected to read headlines about GFA tax evasion and fraud by now.
