The Whole Story of Stanley's Arrest on May
27, 2003 and Today's Detainment at the Denver County Courthouse
Rick Stanley paid a visit to the Denver County Courthouse
this morning, Thursday, May 29th, and wore his gun up to the metal detectors
per Colorado SB-25 state law, turned in his weapon for a receipt and went
through the metal detectors and the security guard didn't know what to do,
so they called the Denver Sheriffs. Stanley was promptly surrounded by ten
Denver Sheriffs who after some discussion, returned his gun, which Stanley
put back in his holster on his hip, and was escorted out of the building.
At this point, the Denver Police Department were called and responded promptly,
and after some iscussion and calling their sergeant, decided that Stanley
violated no law and was released. Stanley returned his weapon to his vehicle,
and returned to the courthouse to file his verified claim for his $2500.00
bond even though the court is bound to return his $2500.00 bond with this
verified claim to bond, after they had approved the payment of the bond
and cut the check, reneged on releasing the bond to Stanley. Judge Patterson,
who was out of town, will rule on Monday, on the verified claim to return
Stanley's bond.
Judge Patterson brought Stanley back to court in March, revoking
his Stay of Execution and insisted that the Colorado State Supreme Court
do an Order granting the stay of execution. With this action, Stanley's
bond should be released as this court no longer has jurisdiction in the
matter of Stanley's appeal. In addition, the Denver court was bound to post
a bond in the case from the very beginning as the charging party and failed
to do so which makes the entire proceeding null and void. The charging party
must post bond and this claim is for exoneration of said bond. This is not
something that the court tells citizens when they are charged with a crime
by the city. All crime must have a charging party and a bond must be posted
by them and not the defendants. The courts have failed their oath of office
to defend the Constitution by not revealing this to every defendant passing
through their court system. Stanley demands that his bond be released.
Stanley left the courthouse without further harassment from
the court or the police. Stanley has been detained twice this week in matters
pertaining to SB-25 because the Denver Police Department, and the Denver
Sheriffs Department have not been properly educated in the guaranteed and
protected right afforded by the State Constitution to citizen open carriers
who are lawfully openly carrying a weapon.
Ignorance of the law has never been acceptable for the citizenry
according to the Courts and it certainly isn't acceptable for the Police
and the Courts to be totally ignorant in the understanding of the law.
Rick Stanley will be picketing in front of the Colorado Supreme
Court Building at 14th and Broadway/Lincoln again at 7:00AM to 9:30AM on
Friday May 30th. Media inquiries can be directed to Rick at that time at
the Colorado Supreme Court Building. As always Rick will be wearing his
.357 Magnum evolver on his hip openly for all to see.
What really happened to Rick Stanley on Tuesday?
I was arrested by eight cops, in eight cop cars, with eight
weapons drawn. I got that information from a fellow who witnessed the scene
that morning. I was back at the scene in front of the Colorado State Supreme
Court later in the day, and he told me I was incorrect in telling the story,
on my bull horn. I had been mentioning six cops, six guns drawn, and six
cop cars. He told me that I was probably a little distracted at the time,
with all those gun barrels pointed at me. Hmm...might of been. After my
arrest, I was told I would be charged with "brandishing" a weapon
as they had someone from inside the Colorado state Supreme Court building
who called in the complaint, and they said I scared the woman. I informed
the cop, that the call was a lie, he was a liar, and the charge was a lie.
They talked about it, between themselves (the cops), and decided to charge
me with disturbing the peace. They took me to the Denver Jail downtown,
and I was put in a holding cell still handcuffed, until close to two hours
from the original arrest. I heard a lawyer in a conference room say very
loudly, "give him his stuff, and let him go".
The cops in the room argued for another ten minutes or so,
and I heard the same woman lawyer say the same thing again. She said that
I had made fools of them, and they had opened the city to a potential lawsuit
and to give me my stuff, and let me go. I was taken out of the cell, out
of the cuffs, and brought to the front of the entrance to the jail where
twenty cops were milling around outside. They gave me my gun. I put the
bullets back in the gun in front of the cops, put on my belt and holster,
holstered the gun and started "preaching" to the cops. I was told
not to preach to them, as they were on my side. I increased my preaching
at that point, and agreed to disagree with the unconstitutional crooks who
had been kidnapping me at the point of a gun a few hours before. I was not
charged, just released. No apologies from any cops for what had happened,
and was not offered a ride back to the Colorado State Supreme Court building
with my 6 foot by 4 foot signs. I stood in front of the jail at 13th and
Cherokee, using my bullhorn, handing out flyers, with my .357 Magnum revolver
in my holster for an hour, called my driver from the warehouse and he picked
me up, took me over to the Colorado Supreme Court building, and I continued
my protest as before the arrest, for several more hours.
On Wednesday, I returned about 7:30 AM and protested in the
EXACT same manner as the previous day until 9:30 AM, was not bothered by
any police and was photographed by Michael Cacciopo of the Vail Speakout
Newspaper, and gave him an interview for the paper he was working on putting
out soon. I was joined about 9:00 AM by Linda Sanders, who mentioned she
was bringing another reporter for a small paper over on Friday morning for
pictures and an interview.

Candidate gave the following media release on Tuesday, May 27, 2003:
Rick Stanley was arrested in front of the Colorado State Supreme
Court building today at 8:00AM, and spent two hours in jail in handcuffs
for exercising his constitutional right to openly keep and bear arms in
Denver, Colorado. After being released, Stanley continued exercising his
right in front of the Denver Police station at 13th & Cherokee and then
proceeded back over to the Colorado State Supreme Court building to continue
showing his 6ft x 4ft sign which reads: "COWARDS COMMITTING TREASON
- DENVER AND COLORADO JUDGES ARE VIOLATING THEIR OATH OF OFFICE - RICK STANLEY
DEMANDS HIS CONSTITUTIONAL RIGHTS BE UPHELD." This will not deter Rick
Stanley from demanding that his constitutional rights be respected by the
City and County of Denver.
Stanley had this to say "I was arrested by a half dozen
Denver Police officers, who bore down on me in six police cars, guns drawn,
for exercising my
constitutional right to keep and bear arms in the city of Denver. I will
be in front of the Colorado State Supreme Court building every weekday from
7:00AM to 9:30AM demonstrating my constitutional protected and guaranteed
